Terms of Service

1. Service Description

APIVAI provides an AI API gateway service that allows users to access frontier AI models (including Claude by Anthropic and GPT by OpenAI) through a unified, pay-as-you-go API. Users purchase prepaid credits and consume them based on API usage (tokens processed).

2. Account Registration

You must provide a valid email address to register. You are responsible for maintaining the security of your account credentials and API keys. You must not share your API keys publicly or with unauthorized parties.

3. Payment & Refunds

All payments are prepaid. We accept credit and debit cards, Alipay, WeChat Pay and cryptocurrency. Alipay and WeChat Pay payments are charged in CNY and converted to a USD balance at the current exchange rate. Account balances and model prices are in USD. Credits are non-refundable once consumed. Unused credits may be refunded at our discretion within 30 days of purchase.

4. Acceptable Use Policy (AI Content)

This Acceptable Use Policy governs AI image and video generation on APIVAI and forms part of these Terms. The following content is strictly prohibited:

• Sexual / NSFW content — pornography, sexually explicit images or video, and non-consensual intimate imagery.
• Violence / gore — graphic violence or gore, and content that incites or instructs violence, terrorism, or self-harm.
• Hate speech — content that attacks or demeans people based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or similar characteristics.
• Child-unsafe content (zero tolerance) — any sexualization or exploitation of minors (CSAM). Such content is removed immediately, the account is permanently banned, and it is reported to NCMEC / law enforcement.
• Deepfakes / impersonation — realistic synthetic media of real people without consent, impersonation of others, or misleading fabricated media.
• Copyright / trademark infringement — reproducing copyrighted works, characters, logos, or brands without authorization.

Content Moderation

We screen prompts and generated outputs in real time using automated AI classifiers and safety filters (including CSAM, NSFW, violence, and hate detection). Flagged or high-risk content and user reports are escalated to human reviewers on a tiered, risk-based basis, and moderation records are retained for audit.

Violation Handling

On a confirmed violation we may, depending on severity and history: delete/block the content, issue a warning, suspend the account, forfeit and zero out the account balance and credits (non-refundable), and/or permanently terminate the account. Illegal content is reported to the authorities. Time limits: child-safety / illegal content is actioned immediately upon detection; other confirmed violating content is removed within 24 hours and account action is taken within 72 hours.

User Reporting

To report content that violates this policy, email w69787200@gmail.com (include the content/link, a description, and the time) or use the in-product Report button where shown. Reports are acknowledged within 24 hours and reviewed within 72 hours (child-safety reports are handled immediately); reports may be anonymous. Enforcement actions may be appealed within 14 days via w69787200@gmail.com.

5. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. Service may be interrupted for maintenance or due to upstream provider issues. We are not liable for losses resulting from service interruptions.

6. Rate Limits

Each API key has a default rate limit of 60 requests per minute (RPM). Higher limits may be available upon request. Exceeding rate limits will result in temporary request rejection.

7. Liability

APIVAI is provided "as is" without warranties of any kind. Our total liability is limited to the amount of credits purchased in the last 30 days. We are not responsible for the accuracy or content of AI model outputs.

8. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance. We will notify users of material changes via email.
